These Terms of Service (“Terms”) govern your access to and use of Waves AI (“Waves,” “we,” “us,” or “our”), including our website, applications, and related services (collectively, the “Service”). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least the age of majority in your jurisdiction to use the Service. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. The Service
Waves AI provides tools to create, publish, discover, and listen to audiobook-style audio content, including content generated or assisted by artificial intelligence. Features may change over time. We do not guarantee uninterrupted or error-free operation.
3. Accounts
You may need an account to access certain features. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us promptly of any unauthorized use.
4. Your content
You retain ownership of content you submit (“User Content”), subject to the rights you grant us below. You represent that you have all rights necessary to submit User Content and that it does not violate law or third-party rights.
You grant Waves a worldwide, non-exclusive license to host, reproduce, process, display, distribute, and create derivative works from User Content as reasonably necessary to operate, improve, and promote the Service, including generating AI narration and making content available to listeners as you direct through the product.
5. Acceptable use
You agree not to:
- Violate applicable laws or regulations
- Infringe intellectual property or privacy rights
- Upload malware, scrape the Service without permission, or probe our systems
- Harass, abuse, or harm others or distribute unlawful or hateful content
- Circumvent technical limits, billing, or access controls
6. AI-generated output
Audio and other outputs produced through the Service may be generated or assisted by AI. Such outputs may be inaccurate or inappropriate. You are responsible for reviewing content before publication and for how you use outputs in compliance with law and platform policies.
7. Fees
Paid features, if offered, are subject to the pricing and billing terms presented at purchase. Unless stated otherwise, fees are non-refundable. We may change pricing with reasonable notice where required by law.
8. Intellectual property
The Service, including its software, branding, and design, is owned by Waves or its licensors and is protected by intellectual property laws. Except for the licenses expressly granted here, no rights are granted to you.
9. Termination
You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms or if we need to protect the Service or other users. Provisions that by their nature should survive will survive termination.
10. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WAVES AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY FOR CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM OR ONE HUNDRED U.S. DOLLARS (US$100).
12. Changes
We may modify these Terms from time to time. We will post the updated Terms and update the “Last updated” date. Continued use after changes become effective constitutes acceptance of the revised Terms.
13. Governing law
These Terms are governed by the laws of the State of Delaware, USA, excluding conflict-of-law rules, unless a different governing law is required by the jurisdiction where you reside.
